AI governance frameworks and AI regulation in Denmark
Denmark governs AI through the EU AI Act, which applies directly, and the GDPR. Act No. 467 of 2025 names the Danish authorities that supervise the AI Act's prohibited practices, while Datatilsynet and Finanstilsynet set out how data protection and financial supervision apply to AI. These are the instruments that apply to Danish organisations, with the EU and international frameworks most of them build on.
Who regulates AI here
- Agency for Digital Government (Digitaliseringsstyrelsen)Coordinates EU AI Act supervision in Denmark as the single point of contact and notifying authority, and supervises most of the prohibited AI practices.
- Danish Data Protection Agency (Datatilsynet)Enforces the GDPR and the Danish Data Protection Act, publishes guidance on AI in public authorities and supervises some prohibited AI practices.
- Danish Financial Supervisory Authority (Finanstilsynet)Supervises banks, insurers, pension companies and other financial firms, and sets out its expectations for how they govern AI.
Denmark
Denmark applies the EU AI Act through a national law naming its supervisors, with Datatilsynet guidance on AI in public authorities and Finanstilsynet expectations for financial firms.
European Union
The EU AI Act sets risk-based obligations for AI placed on the EU market or used in the EU, alongside the GDPR's rules on automated decisions.
International
Standards and frameworks that apply across borders. Most organisations use one of these as the backbone of their AI governance, whatever their jurisdiction.
Questions
Does Denmark have an AI law?
The EU AI Act applies directly in Denmark. Act No. 467 of 14 May 2025 supplements it with Danish rules on supervision and fines, and has applied since 2 August 2025. A broader replacement bill, L 111, lapsed with the general election in March 2026.
Who supervises AI in Denmark?
The Agency for Digital Government coordinates EU AI Act supervision and shares supervision of the prohibited practices with Datatilsynet and the Danish Court Administration. Who will supervise each high-risk area is not yet settled. Datatilsynet also enforces the GDPR, and Finanstilsynet supervises AI use in financial firms.
Can Danish public authorities make automated decisions with AI?
Only in narrow cases. Datatilsynet's guidance says a public authority can as a rule only make solely automated decisions with legal or similarly significant effects where the law provides for it, and a citizen's consent will not normally be enough.
When do the EU AI Act high-risk rules apply in Denmark?
Obligations for Annex III high-risk systems apply from 2 December 2027, and for high-risk AI in products covered by Annex I from 2 August 2028, under the AI Act as amended by the Digital Omnibus. Prohibited practices have been banned since 2 February 2025.
